Legal Question in Family Law in New Jersey

separation

I am thinking of divorcing my spouse. He has asked me to leave the home and I think its best for the children not to see us fighting. I am afraid of child abandonment charges. Is there anyway to protect myself if I move out?

You can leave the house and take the children with you. He has no more right over the children than you do. Of course, this could lead to a messy situation. Regardless of what you do, I suggest you work with an attorney to help you through it.

You should not be leaving the house because you seem to be leaving your children behind which may impact on the issue of child custody. If he is harassing you; threatening; assaulting you or engaging in other misconduct perhaps you should obtain a domestic violence restraining order

requiring that HE leave the house.
