separation

my wife and i separated do we need an agreement written up i want to protect myself incase i do

It all depends on what you have and what you earn and obtain in the future. Assuming there are no children (you did not mention any) and a short term marriage, there are still property issues to address. The usual dates for determining what property gets divided are the marriage date (unless you lived together before the marriage) until the filing of a Complaint for Divorce (unless you have agreed to an earlier date in a Separation Agreement).

I advise clients to get one prepared if they are not reconciling quickly and to make it part of the Divorce Judgment where appropriate.

In New Jersey, in order to be legally separated you need a written agreement. Also, to protect yourself and your property a written agreement is essential.
