Legal Question in Family Law in New Jersey

Seperating the Children

4 months ago I decided to seperate from my husband. We have 3 children and since I couldn't afford to move out on my own, I just moved into the spare bedroom. Is this a legal seperation since we are still living in the same house? Also, I plan on saving to move out on my own with my youngest daughter, and then visiting the 2 boys during the week, being there when they get home from school, taking care of them and feeding them until their dad gets home in the evening. Can he do anything legally to prevent me from making this situation happen?

Your question cannot really be answered without more details concerning your present situation. Your options would also be different depending upon your present financial circumstances, your present job situation and your ultimate goals as to custody, equitable distribution, etc. You need to immediately contact an attorney who practices Family Law and talk with him/her to discuss your situation and get your various options.
