Legal Question in Family Law in New Jersey

Share of Retirement Money

I was divorced 6 or 7 years ago and was awarded 18000 dollars from my ex's retirement fund. I was told by my lawyer at the time that a company would contact me to make the change over into my account and would cost me 500 dollars. I never heard and have asked over the years. I''m not sure if there is a time limit on when I have to have the money removed,or how to go about getting it. What kind of lawyer or organization am I suppose to contact to help with this matter.

You need to have a Qualified Domestic Relations Order entered by the Court, commonly called a QDRO. This is usually done by a independent company.

I would need more information to give you a more detailed information.

I would be happy to follow up with you. Please email me directly or call my office if you would like to schedule an appointment either in person or by telephone. My contact information is listed in the links below.

Re: Share of Retirement Money

A separate Court Order should have been prepared, called a QDRO or Qualified Domestic Relations Order. If you do not want to return to your former lawyer to accomplish this, you should contact a Family Law attorney. Do this as soon as possible.

Keep in mind that this advice is given based on the little bit of information that you have

provided in your question. My advice may change based on other information. Further, no one

can rely on advice from an attorney who has not been retained. You cannot rely on this advice

because we have not personally met and you have not retained me as an attorney. If you have not

already done so, you should immediately meet with an attorney for a full consultation before you

take any further steps. You may feel free to call me to discuss this matter in more detail. If you

do so, mention Law Guru and your first one hour of time will be free. Good luck! Rob Gleaner
