Legal Question in Family Law in New Jersey
Can I sign over my house to my husband so I can move out?
My husband has been leaving our house in such a mess (the junk in the yard is unbearable) that we would not be able to sell it. Also, it is in a flood zone which already makes it hard to sell.
I want to l leave him but the house is in both of our names. I would like to sign it over to him. There is basically no value over what we owe because of how he has let it go.
He just sold his business (a junkyard) and made $85,000 from it. He gave me $20,000 to catch up on my bills (he hasn't been contributing to the household bills for at least a year). He has many bills to pay off which I have started doing. I was the bookkeeper for the company which I did not get paid for.
Is there any chance I can sign the house over to him so I am free to go off on my own?
Also, if he has any profit left over, would I be entitled to any of it? Our daughters are both home & a granddaughter but both daughters are over 18 yrs old.

Re: Can I sign over my house to my husband so I can move out?
You can sign over the house, but that will not end your problems. You will still be obligated on the mortgage. And, in response to your question concerning whether you may be able to get any amount if there is profit when the house is sold, you would not be there to protect your interest. You need to immediately consult with an attorney. If you want me to assist you, call me at 856-546-8010; mention LawGuru and your first consultation is free. Good luck! Rob Gleaner
