Simple Assault Charge
My father is being charged with simple assault because my nephew told DYFS that my father abused him. My father was yelling at my nephew for lying and he was telling him that he was tired of the lies. My nephew raised his hands and my father slapped him and my blood was on my nephews nose. My nephew ran away 3 days later and stayed gone for a week. He was seen twice by family members and each time he ran from them. On the seventh day he was out of the home my mother saw him and made him get in her car, he than told my mother my father punched him in the nose and that it hurted. My mother took him to the emergency room and they said his nose was fractured but it was healing. She was instructed to make an appointment with his dr is needed. Dyfs has removed him from the house stating he is being abused and charging my father with assault. What should we do and will my father have to go to jail? My father is 61 with a bad heart condition.

Your father is in some trouble, but it should be solved if handled properly. For a simple assault your father is not likely to go to jail.
