Legal Question in Family Law in New Jersey
I am a single dad, permanently disabled, with sole custody of my 2 sons living with me. One is 22, recently graduated from college and not able to find a job. The other is 13. Their mother was ordered by the court 6 years ago to cover them and me with health insurance & to pay me child support. She lost her full time job on June 2nd and has been unable to find full time work meaning I have had no child support payments since then and the 3 of us have had no health insurance. She works a meaningless few hours a week now at a different place of employment. She has no benefits whatsoever. In July I applied for NJ FamilyCare. I just received a letter of denial stating that I am too far above the "poverty level" in SS disability benefits to receive health insurance. What do I do if one of us needs a doctor or a hospital??? Is there any other agency in NJ I can apply to for medical insurance? We are all not going to be healthy forever. I can't sleep at night.

Your 22 year old is a college graduate and should not be looking for child support. He needs a job, any job. Your 13 year old can get medical insurance under the New Jersey Child Care program because your low income level qualifies him. Some mistake must have been made. You need to appeal the decision to deny you coverage. There should be a procedure for appealing the denial of insurance coverage. Legal Services may offer you help with this problem.
