Who has legal custody of a child born to an unmarried couple ?

Your question should be "What are the rights and obligations of two unmarried people relating to their child?" The way you have worded your question - "Who has legal custody of a child born to an unmarried couple?"- seems the intent to perpetuate a power struggle, i.e. "I have legal custody so things must be done my way." Is this any way to begin the life of the child? Both parties have the obligation to raise the child, physically, emotionally and financially. I am assuming (perhaps wrongly) that the two of you are not a couple at this time. If that is the case, both of you are going to need to find a way to compromise on all issues. You are stuck to each other for at least the next 18-25 years. You'd better figure out how to do things in the best interest of the child. I might suggest mediation for both of you. There are plenty of good mediators out there who could assist you in this case. In fact, I have been trained as a family mediator and would be happy to assist you.
