Re: Size of alimony

Alot...for a long time. Two of the major factors in an alimony award is length of marriage and ability to pay. Both of those factors cut against you. There are several other factors including the actual need of the spouse, the age, physical and emotional health of the parties, the standard of living established in the marriage and the likelihood that each party can maintain a reasonably comparable standard of living, the earning capacities, educational levels, vocational skills, and employability of the parties, the length of absence from the job market of the party seeking maintenance, the parental responsibilities for the children, the time and expense necessary to acquire sufficient education or training to enable the party seeking maintenance to find appropriate employment, the availability of the training and employment, and the opportunity for future acquisitions of capital assets and income, the history of the financial or non-financial contributions to the marriage by each party including contributions to the care and education of the children and interruption of personal careers or educational opportunities, the equitable distribution of property ordered and any payouts on equitable distribution, directly or indirectly, out of current income, to the extent this consideration is reasonable, just and fair and any other factors which the court may deem relevant. Obviously, a careful examination of your situation needs to be made. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention LawGuru, there will be no charge for your first consultation. Good luck! Rob Gleaner
