Legal Question in Family Law in New Jersey

my soon to be ex and I sold our home. We had a 100K Heloc that was paid off. He will not release the funds unless there is a full accounting of the monies. The loan was taken out while we were married. Don't we just split the funds (that are still in escrow) ? The funds were used for household expenses.

If a divorce action is pending, your attorney can move to ask the court to release all or part of the funds, but there may be other issues that would result in the escrow being continued until settlement or trial, such as claims for credits, status of other assets or debts, etc.
