sole custody

Is it possible to get sole custody of my son if the father is in jail? (for drug abuse and theft) The projected parole date is 4/26/2009. There has never been an order stating who is legal guardian.

You should immediately go to the family part of the

county courthouse in your county and file for custody.

If there is no court order regarding custody then why not file for sole custody of your child now?

Yes, of course there is a good chance of this. You will want to ask the Court to order some other things to assist you and your child, too.

You are likely to be more successful with an attorney representing you.
