Legal Question in Family Law in New Jersey
I have sole custody of my son can i move to another state? Help Please
I have sole custody of my son. His mother has not seen him for over three years. She was ordered by the court to undergo a risk assessment, in order to even have any visitation at all, she has not finished up her part and thats been 2 years. She is allowed to talk to him over the phone once a week which i allow, but she doesnt always call. I want to move from N.J. To Florida for a change of location and to take a full time position in a field in which i am part time now( table games dealer) and they do not offer full time in that position where i am at. not to mention my parents are going to move to Florida and i need them to help with my son since i am single father. Am I allowed to move?

You must first file a motion before you move. I would be more than happy to discuss this with you in more detail as it could be quite complicated.
My initial consultations are always free, so call me at 732/247/3340 to discuss your case.

Sole custody is not what matters. What matters is that your reasons for moving seem to be reasonable and legitimate. The Court will probably approve your moving to Florida.
Call me if you like.

You will need written consent in the correct form from his mother, or you will need to file a Motion and ask the Court for permission.
You would be very smart to get a lawyer to help you with this.
If you are in northern NJ, give me a call.
I never charge for a first phone call.
You can then decide how you would like to proceed.
