I want my son back

In early Sept 2007, I relapsed after being clean for 2 years. My son's dad got temporary residential custody. I have been in recovery and in a program for 5 moths. I have 3 supervised visits a week, although he gives him to me way more time. He keeps harrassing me on voicemails because I refuse to go back with him. He is emotionally destoying our son, and the conditions he lives in are horriblew, but the judge only looked at MY problem. I have a lawyer but he seems to be dragging his heels. I have done everything that w3as ordered for me, can my next step be regaining custody? How should I go about it?? Please help!

You should file a motion to restore your custody of your son in the action which gave custody to the father, alleging the harm your son is suffering in his care.
