Legal Question in Family Law in New Jersey
My son needs his Daddy
My soon to husband wants to adopt my son. He is the only father that my son, who is three, had ever known. His biological is not on his birth certificate and he has had almost no contact with him. Maybe three times in three years equaling 4 hours all together. He does not pay child support nor have I asked him to. What would be the process from my husband to adopt him?

You have to file a motion with the court. You can either do this by yourself or through an attorney. While an attorney "may" may things easier for you, the court does have fill in the blank forms for people that do not have an attorney. You could go to the court and see what it would be like in order to decide if you should do it yourself.
I suggest an attorney when the other side will contest it, but in cases like this, you may be able to get away without one. It all depends on your finances.
My initial consultations are always free, so call me at 732/247/3340 to discuss your case.

Your husband would file a petition to adopt your child with your statement of consent thereto and the petition would be served on the father after it
is filed with the Court.
Call me if you like.
