Legal Question in Family Law in New Jersey

Son's College

I have a problem. My son was involved with some drugs a few months ago. Now he's been clean for over a month and he goes to drug counseling. His father refuses to send my son to college in September, he wants him to wait till November. My son is eager to go and start his life. His school is an intense technical school, it's not a party school, but he also does not want to do anything like that again. He wants to go, learn about he chosen career and start his life. I want my son to go in September, I think it will be great for him. My question now is, can I take my ex-husband to court and have him help me pay for expenses to get my son down to Florida, apartment rent, airline ticket, bed, etc? He says he won't pay anything until November. Can he do that?

Re: Son's College

This situation is unclear. A lot will depend on the details, the language of your divorce judgment and settlement agreement, the details of your son's situation.

What is reasonable in this situation? If you and your ex can not agree on what is reasonable, then you will have to ask a Judge (quickly, by emergent motion, most likely) to decide.

I think you will need to review it in detail with a divorce attorney to get a clearer idea of your options.

Re: Son's College

You need to file a motion. You can do this without an attorney, but I suggest you at least consult with one before doing anything.

My initial consultations are always free, so call me at 732/247/3340 to discuss your case.

Re: Son's College

It would be necessary to file papers immediately with the Court, on an emergent basis, for an order requiring the father to pay for school beginning starting in September, if there is already a court order requiring the father to pay for college. You should call me in any event to discuss your situation.

Call me if you like.
