can my son's father get a decrease in child even though he hasnt seen our son in 5 months, doesnt provide health insurance. he is working part time and receiving unemployment. our son was recently diagnosed Autistic, his father has not played a positive, stable and structured role in our son's life

Without knowing what numbers were used to calculate child support in the first place and without seeing his motion, no one can tell you what the chances are of anything happening. Child support is not necessarily related to his role in his life, it is usually based on income, his prior income when support was originally calculated, what he has provided to the court ini this motion to show a substantial change in his income to allow him to receive the reduction. If your son now has a medical condition, you might be entitled to include recurring medical expenses that are not covered by insurance. If you are paying for insurance, you should ask the court to include this in the support. I also suggest you call an attorney to review this matter with you.
