Legal Question in Family Law in New Jersey

Spouse helping herself to best household items

Hello,

1) The divorce papers were filed end of November. I understand that my spouse of 25 years is planning to move out around the end of the month, though I do not know for sure when. We have not communicated for 6 months now. In the meantime she has been collecting the good household items and keeping them in her bags. I know that when she moves out I will be at work and she will help herself to the best of our belongings (furniture, electronics, art work, etc). I am fully willing to have a fair division of property, and I have told her so in a letter I gave her early November. However, she ignores all communications. What can I do legally?! I have paid for the house and all the belongings.

2) Our auto insurance expires today, and a few days ago I left my spouse a note asking whether she intends to continue on the same joint policy, and if so to leave a check for the premium for her car, else I would assume she has got another policy. She again did not respond, and last night I paid up her policy as well. Can I drop her from my policy without having any legal problems.

Re: Spouse helping herself to best household items

Dear Sir:

From your statement, it is clear that you are long past the 'post on the internet and get general advice'stage. You need a divorce attorney. If the 'divorce papers' which you say were filed in November was in fact a divorce complaint and summons, then you need to take action immediately, today. You do not want to 'default' on your divorce case, it could affect your rights seriously.
