Legal Question in Family Law in New Jersey

Can my spouse hire my prior divorce attorney

Hello! I had filed for divorce a couple of years ago, and later withdrew the divorce complaint to pursue reconciliation. I now want to file for a divorce but want to change the attorney who represented me when I earlier filed for the divorce! Can my wife now retain my former attorney if she chooses? I do not want that to happen!

Re: Can my spouse hire my prior divorce attorney

No, she can not. Your former attorney can not discuss anything with her in any way related to you and her.

YOu need to hire a decent divorce attorney.

Re: Can my spouse hire my prior divorce attorney

In preparing your prior Complaint for divorce, your former attorney was likely able to review documents and gather information that would now create a conflict of interest if they were to represent your wife in an action. If your former counsel is retained by your wife, you could file an application to have them removed from the case.

Our firm has experience in handling these types of matters and can discuss your options with you.
