Legal Question in Family Law in New Jersey

Does my spouse have to pay child support for my child of a previous relationship

I have a 12 year old son with a man that I never married. He moved to California last year and within 6 months I allowed my son to live with him because he really missed his dad and he wanted to live with him. I am married and a stay at home mom with 3 other children. My son's dad told me that he does not expect child support from me due to the fact that I am not working, but when I do start working he would like something. And he also told me that he would pay for the plane tickets every time my son visited. Well I should have known that he would soon be asking me for money every month from my husband and wants me to pay for half of the plane ticket. I think this is absurd considering he moved out to California and messed everything up. I want to know if my husband is legally bound to pay child support for my son. Thank you

Re: Child support obligation to step-son?

Your husband has no obligation to support your son. But you do. And even if you do not earn any money, in certain cases, a Court would impute income to you, meaning that they would pick an amount that they think would be fair, for your income, if you were working. Whether or not this would occur cannot be determined until a full evaluation of your total situation is made. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, you may want to contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. Good luck! Rob Gleaner
