Legal Question in Family Law in New Jersey

spouses legal rights to property and ability to evict?

I am in the process of a divorce my question is two fold. I have purchased my spouses portion of our household from her. This was in process before divorce proceedings began we have signed paperwork stating that this is now untouchable by the other in the divorce. Will this hold up in court? My second part is since i am the sole owner of the household what rights do i have to remove my spouse from the house? She still resides in the home. So do i also reside there. Since this has been amicable so far but issues have arrised and threats of '' taking me for all i am worth'' can she touch my assets even though we have signed these papers? We have listed who gets what from the household my attorney has a copy yet we are not doing a property settlement. Also if i begin a relationship with someone does that affect my ability to get this divorce? Can it be considered adultry and cause a longer divorce?

It sounds like you and your wife have drawn up a homemade agreement as to part of the marital assets. If the agreement is properly drawn it is enforceable. I need to review the agreement. Please call me.
