Legal Question in Family Law in New Jersey

Don't know what to do or where to start

My mother went for custody of my son behind my back. She lied when she went to court and gave them a false address(she left off my apt. and changed my zip and sent it in my maiden name which I haven't used in ten years) She also lied and said that my ex husband was my son's father(we had a paternity test done in 2004 and it was determined he wasn't. I had a test done and the results back with his real father four months before she filed) I was never notified of court and she lied and said that I had no contact with nor any knowledge of where my ex husband lived(my other son that is with him was living with him at that time and he was going to school from his house so I have records). I don't know where to start or what to do. She has lied to the courts and stolen custody of my son. Do I have a chance of getting him back(she's only had temporary full custody since december of 2007)

You need to file a motion under the matter in which she got custody, requesting that the order granting her custody be vacated because of fraud and lack of notice of the proceedings.

You do not mention why your mother had temporary custody, which is important.

From a procedural standpoint there is much you can do since the Order seems to have been procured fraudulently and without proper notice. This does not mean you will get your son back without first providing a complete factual basis as to why you are now ready to assume custody.

This matter is too complicated for you to handle without an attorney.
