Legal Question in Family Law in New Jersey

out of state child visitation

My son and girlfriend share custody of their son through a verbal agreement only. There is no court ordered arrangement, custody varies weekly depending on work schedules etc. Our son has asked us, as the grandparents, to bring his son to our residence in North Carolina for an extended visit, in order to provide a more stable environment. The child's mother has been exhibiting erratic behavior. Do both parents need to be in agreement and what happens if an agreement cannot be reached? Can we bring him to NC on our son's say-so alone?

I suggest you get an attorney to make all of this official with the courts. Otherwise, things can get very crazy at any point.

You need to have a written agreement signed by both your son and your grandson's mother, before you take custody for an extended visit.

If your son lives in northern NJ, please have him call me. I would be happy to assist him.
