Legal Question in Family Law in New Jersey

In the state of NJ is a non-custodial parent required to pay both child support and college tuition if a child is living away at school? Will the court require the non-custodial parent to file for bankruptcy in order to finance a child's tuition at a more expensive school if the parent agrees to pay half the tuition of Rutgers?

Yes, but you can probably get a reduction in child support. A court cannot force you to file for bankruptcy. Sounds like you need to speak with an attorney about all this. Feel free to call me at 732/773/2768.

There used to be the Rutgers' Rule which was that a parent need not pay more than the tuition

for attendingt Rutgers. I haven't dealt with this question and would have to do some research.

Call me if you like. I see that you are in Toms River and would expect that you will seek the

services of a local lawyer, but my services are available for Toms River.
