Legal Question in Family Law in New Jersey
How soon is to soon for step father to adopt
I've been married for 7 months and have a 2 year old son from a previous relationship. My son's natural father has hardly been around and barely paid child support unless he was aressted on a warrent and forced to pay. He has not even tried to see my son. My husband has raised him since he was one and wants to adopt him. How soon is to soon and how likely will we win.
P.S. the birth father is a jerk and no matter how much he doesn't come around when it comes time for custody he'll actually try to fight it. With no job and everything

Your husband can file to adopt your son now.

Under the circumstances that you've presented, it appears that your husband would have a pretty good chance of obtaining "father-status" even in a contested action. He should immediately obtain an attorney to begin processing the application. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, you may want to contact a Family Law attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. If you call me, mention Law Guru and your first one hour consultation will be free. Good luck! Rob Gleaner
