Legal Question in Family Law in New Jersey
step parent rights
If I am married to a woman with a child(adopted) from a previous marriage and she passes away, will I have any rights to see the child?

Re: step parent rights
If you are saying that you have adopted the child you are the child's
father under the law. If you mean that
the child was adopted by your wife and
not by you that means that you would have to file a custody petition with
the Court to have custody or visitation. I believe that I need more information to properly answer your question.

I think the best thing to do would be for you to adopt the child as well. I have a client that is in almost the exact same situation and that is what they are doing. Shouldn't be that difficult either, but I would suggest you get an attorney unless she did it herself last time and already knows the ropes.
