Legal Question in Family Law in New Jersey

Can I stop my ex-husband from moving out of state . . .

My ex-husband and I hav joint custody of our 3 children. They reside with me. He will be moving to Montana shortly. He now takes the children every other weekend and 1 nite during the week for dinner. He retired last Sept. Is my decree still valid if he moves? Can I petition the courts for more money since I will have them 24/7? Any info will be helpful.

Re: Can I stop my ex-husband from moving out of state . . .

As long as he is not asking to take the children out of state, there is really nothing you can do to stop him from moving. On the other hand, this may be a factor that would dictate a change in child support. The exact manner in which it would affect the child support amount cannot be determined without a careful review of all factors. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention LawGuru, there will be no charge for your first consultation. Good luck! Rob Gleaner
