sue for custody

can my ex husband sue me for full custody of our child because i'm not an American citizen (i'm Canadian)?

Your ex can seek custody at any time, and you will have to fight him.

There are many issues involved in a custody fight. The fact that you are Canadian does not by itself mean that the children should not continue to live with you. That is pretty clear.

How to handle this? You really, really need advice from an experienced family law and divorce attorney.

Citizenship is not a part of the custody determination, normally. In this country Canadians are not really thought of as foreigners.
