Legal Question in Family Law in New Jersey

summer visitation

My divorce decree mentions the normal visitation schedule but is silent as to a 1 or 2 week ''vacation'' on summer or winter break. If I want my kids for 3days to a week and their mother refuses , do I have to go to court or is a week of vacation pretty much implied?

Re: summer visitation

Nothing is implied; if it is not in the Agreement, and the parties cannot come to an agreement, the Courts would be required to make a determination. It is unfortunate that the two of you cannot come to an agreement on such a simple issue. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. Good luck! Rob
