Legal Question in Family Law in New Jersey

Superior Court Civil Action Order

My ex-husband filed a motion with the courts to stop child support. I then received the offical judgement that child support has been terminated as of the date the motion was filed. The papers have a judges stamp, the date it was filed is half missing, and the judgement was sent to me from my ex, not the court. When I contact the court and reference the docket # on the paper, they tell me it belongs to another party, and give me a different docket #. Looking over the motion he filed, I noticed he signed my son's name, not his. The judges paralegal (who I now believe may be a friend of my ex's) said she does not know why I didn't get a copy, and sent me over to another person to request a copy be sent to me. The problem, they said they need to research it, as they cannot find anything with a judgement, or with the docket #'s I gave them. Why would my ex be the one sending me the judgement if this was legal, and why is the docket # wrong on the judgement order, and why has he signed my sons name on the motion? How can I tell if these papers are legal?

An order under the wrong docket number is nothing. What matter is what is in the case file and what is in the Court computer which you can learn with reasonable inquiry.

I would suggest that you make a trip to the court and ask to speak with the Clerk of the Court. Show the clerk your documents, and explain that no one in the clerk's office can find your case with the docket number that you have been given.

Also inform the clerk that you were told by the judge's assistant that a copy of the order was sent to you.

Provide the clerk with the names of all parties involved and see if your case can be found.

I agree with Ms. Wooten, time to head off to the court and get an offical copy.
