Legal Question in Family Law in New Jersey

Support

Husband moved to Europe 5 years ago to start a business with our life savings. Family was supposed to join him in 6 months. He began an affair, lost our money when his business failed, moved us to Europe then threw us out of his home and did not support me and children for three years. He's still living in Europe but now giving me money each month. Whenever I mention divorce, he says if I try to divorce him, he'll stop working or only make enough to support himself but not me and the children. If I do divorce him and get a support/alimony judgement against him, can he legally not work and refuse to pay support/alimony?
