Legal Question in Family Law in New Jersey

My ex was suppose to remove my name from the mortgage 2 years ago and still hasn't done so. Now the mortgage is in foreclosure. I want to claim the property on my upcoming taxes this year. Am I able to do this although I don't live on the property. Our psa says he was to refinance and pay me equity and he has not done either.

Your accountant can answer that for you but if you don't live there and its not in the agreement, you could run into issues with the IRS. You need to file a motion asap to get back into court and deal with this. Call me at 732/773/2768 to discuss.
