Surname Changes

I would like to know if i have my son's surname the same as my maiden name. My husband left me after i was pregnant and filed for divorce right away. I went through the pregnancy alone and gave my son my maiden name. The court said i have to find the law behind this but i cant. Is it a law that if we are married the child must take the fathers surname? Its on the birth certificate as my maiden, and the father's name is on the birth certificate as the father, what can i do???? I must find something out ASAP. Please help

To be honest, this question has not come up before. Usually the mother is trying to get the father to give the child his last name.

Logically, there is no reason why a child can not be give the mother's last name. Some researach is required to answer your question accurately.
