I am taking my baby's father to court to file for custody of my son. can he still get any type of custody if he has warrants and he 's on the run?

You already have custody of your son. There may not be a Court Order or anything in writing that says you do; however, by taking control of your son's life and raising him from day to day, you have custody. Your larger question is what rights does the father have. That depends on what he asks for and whether the Court believes his requests are reasonable. I question how he would assert those rights. If "he's on the run", what makes you think he will come into a Court House to respond to your requests? If he does, and if you bring the warrants to the attention of the Court, wouldn't he be arrested? Will he risk that?
