Tax Returns withheld and not applied to arrears balance
I live in the state of New Jersey. My child support case is State of NJ vs. me. The child and mother live in the state of AZ. In 2003, my Federal Tax return was withheld to offset my arrears balance (I understand the reasons why and that it may take 6 to 8 months to be applied to the balance). The dollar amount withheld exceeded the balance and the letters from the Federal government are dated April 2003. The money withheld has yet to be applied to my account (now nearly 11 months later), sent to my daughter and the balance returned to me. In addition to that, they continue to take additional weekly money against the arrears balance. I have tried to work with the case worked but after faxing the letter to them in January 2004 and numerous unreturned phone calls; I am still waiting for this to clear up. I have prepared my 2003 tax papers and am looking at another tax return. Should I contact an attorney to take a more legal and stronger approach? Thank you.

The system is at work here. The problem is that you are going to have to pay an attorney to work through the system. You probably need to file an application with the Court in NJ to modify your arrears, stop the additional funds and to require PRobation to immediately credit your account appropriately.
