taxes not paid on real estate

I was divorced a year ago. We went thru a mediator. Together, we owned 3 pieces of property. One was the primary residence of my ex husband and the other two were rental property in another state. We agreed he would keep the unit he lived in and I would get the 2 out of state units. They were fairly equal in value. I find out a year later that he did not pay the 2004 property taxes on either of the 2 units i received in the settlement. All rental income was sent to him and he was solely responsible for paying the household expenses. How do I legally get him to pay these taxes in the amount of $3900. ?

Many agreements cover this scenario - that is, how back taxes and other carrying costs are dealt with. If your agreement did not cover this, you may or may not be able to make a claim. It really depends on the wording of your Property Settlement Agreement. Assuming he has an obligation to pay, per the Agreement, if he does not repay you voluntarily, the way to get him to pay it is by filing a Motion and asking a Court to order him to pay it.

Keep in mind that this advice is based purely on the little bit ofinformation that you have given to me. There certainly may be other facts that would change my opinion. You will have to file a motion with the Court to compel his payment of these taxes and for attorney's fees.

You need to file a motion with the court. You should probably do this without an attorney do to the low amount involved.
