Legal Question in Family Law in New Jersey
Teen Pregnancy with older partner
I am writing on behalf of a 15 year old female who is pregnant by her 22 year old partner. As the legality of their relationship is an issue (New Jersey), she is wondering about claiming him as the father once she gives birth. Will this lead to any legal repercussions and what other issues might arise (such as child support). Any information you could provide would be appreciated. Thank you.

Re: Teen Pregnancy with older partner
Since there are seven years difference in age, an issue exists as to statutory rape. I would need to research this question but feel it is a strong possibility. Having a Meghan's Law registrant as a dad may not be desired. I think that a fair voluntary support should be determined and this based on the dad's earnings, etc. The father may challenge the paternity also and then a patermity suit seeking testing of DNA would be ordered. Is there any relationship? Will there be dual or joint parenting or will the Dad be evading contact and/or support? These are a few of the questions in a complex scenario that will involve a young life. If there is time before the expected birth these things may be approached and explored.

A female under the age of 16 can not lawfully have sexual relations with someone who is more than four years older than she is; it is call statutory rape.
