Legal Question in Family Law in New Jersey
How to terminate parential rights
My son's father has not been in my son's life for 8 years now. During our relationship he was in and out of jail for many things, at one point I had a restraining order against him witch he talked me into removing. He has threatened me and my family. I am now married and my husband would like to adopt my son. I heard somewhere that all I need to do is place an add in a news paper and if he dosent respond his rights are terminated, is this true if not how do I go about terminating his rights without contacting him if possible?

Re: How to terminate parential rights
If you know where your ex-husband is, he must be given notice of any action to terminate his parental rights. You need to file a motion to teminate parental rights. You do not say whether you get any child support from your ex-husband or whether he has seen his son at all in the last eight years. These are some of the factors the court will consider.

Your current husband would have to adopt your son and substitute as his father. Parental rights are not so lightly discarded.
