Legal Question in Family Law in New Jersey
Trip out of the country
We have joint legal custody of our 4 children my oldest being 10 yrs old and I the residential parent want to take them to a family reunion in Uruguay South America. I asked my ex husband if he would sign to start renewing their passports but he refused. What can I do? If I take him to court what are the chances that the Judge would grant me authorization to take them on this trip? Thanks In advance for your support, extremely appreciated.

The judge would require assurances that you intend to return to this country. One problem you may have is that Uruguay is not a signatory to the Hague Convention, a treaty by which countries agree to compel violators of visitation and custody rights to the country of the custody of visitation order.

You should be able to get the Court to allow you to take this trip. If he will not be reasonable, then hire a divorce attorney and file the Motion which is needed to ask the Court for permission.
You will have to do it right, and will need to persuade the Judge that you and the kids will be returning.
