Legal Question in Family Law in New Jersey

Undisputed allegations

I posted this... I was reading my appellate decision and it was mentioned SEVERAL times that the claims went undisputed... on more than 10 occasions I objected as well as wrote answers to the allegations disputing them, submitted addendums and reports to the courts disputing the allegations but I never testified. Do they only rely on testimony as a dispute to allegations?

I wanted to clarify but I can not place a reply on my orginal message. I was asking, what do the courts deem undisputed?? If you object to what the prosecutor is saying, is that considered a disputed statement? If the prosecutor files a verified complaint, to which I respond with an answer disputing the allegations, if I do NOT testify, is my answer considered as a dispute???

The DAG mentioned several false allegations to which I responded by writing an answer and addendums and motions. I never testified on my own behalf. In the appellate decision, the judge stated several times that I did not testify to the ''undisputed'' allegations. I believe when you submit an answer and motions etc, that it is disputed... am I right or did I need to testify???

Re: Undisputed allegations

No, you don't need to testify to dispute the claims. Are you sure they had everything?
