Unreasonable Child Support

My husband's ex girlfriend wants an increase in child support plus for him to pay for half of daycare(300 dollars a month).We have offered this girl alternatives such as my sister in law to watch my stepson for $200/month and we would pay half and increase the support to $65/week. This is an inconvenience for her and "a ridiculous offer" so she won't even entertain the idea. The only inconvenience is that she has to leave 10 min. earlier for work. My step son has been in daycare since 18 months old(8-10 hours per day) even when his mother wasn't working. Is it possible for a court to force a father to pay $300 plus $400 a month child support. She makes almost $300 more a month than he does. He brings home $420 biweekly after child support and taxes. We have a mortgage, car payment etc. plus maybe another baby. What can he do??

I can only answer your question generally because child support is set in accordance with the Child Support Guidelines (which can only be determined when all relevant financial data is available from both parties) and changes in that amount can only be made when one party or the other establishes a substantial change of circumstance. The ex may or may not be entitled to an increase after all relevant data is obtained and the numbers are computed in her favor. On the other hand, a court probably would consider cheaper alternatives. The Dad certainly appears to have some good arguments here and I would suggest you immediately obtain an attorney who practices in the area of Family Law.
