Legal Question in Family Law in New Jersey
Unsure of what to do
In 2006:
I filed for Child Support in which:
1. Child Support Payment was agreed
2. Paternity was confirmed verbally
3. No visitation rights were established
4. When judge asked if the father wanted parenting time he said no so in the child support papers I have 100% parenting time he has 0%
Father was calling once every month or so and I will drop off my daughter Saturday and pick her up Sunday (he lived 45 minutes away) On December 28th 2008 for the first time he denied me my daughter when I went to pick her up and had me half hour going around in circles trying to find her since he was not at his residence so I had to go to the police to get her back. At that moment he said he did not care to see her again. After this stunt I am very worried about her safety and mine. He called once a week ago but I didn't respond. I am not sure what to do. Please help

Re: Unsure of what to do
You are right to be concerned.
You may want to go back to Court to get an Order on visitation, I am not sure what your best course is just based on the info you gave.
You really need to get some clear advice from a divorce attorney (this is a divorce type problem).
Let me know if I can help you. I am in Hackensack, right across from the Bergen County Courthouse.
The question you posted shows that you are in Morris County; I do practice there and can help you.

Re: Unsure of what to do
If, as it sounds, he has no order allowing visitation (or parenting time) you have no obligation to allow him to see the child. Let him bring a motion and have the Judge set specific times and ground rules. Depending on the age of the child, some period of supervision may be necessary. You would be wise to have an attorney represent you and we offer a free first consultation if you want further information.
