Unwanted Divorce
My hushand of 13 years wants a divorce. What can he do to get the divorce if I don't agree?
We have two childern under age 7. How good is my chance to get the custody of both of my childern? He says that he wants the boy (older) and I keep the girl. I spend much more time to take care of the childern than him. But he makes more money than me.
Is it better for me to get an attorney to protect my rights in the divorce? Thank you.

Unfortunately, if one person wants the divorce, there is nothing that can stop him from getting it. The only issue is how long it will take and the cost (both emotionally and financially) of getting there. It's hard to say, at this point, what the chances are of your success on any issue, without having more facts. I can say that in general all child related issues are determined based on a standard known as "the best interests of the children". After hearing all of the facts and circumstances, including listening to all expert witnesses, if any have been hired by the parties or appointed by the Court, the Judge would make his/her decision based on what he/she feels would be in the children's best interests. In order to get a strong opinion as to the direction in which you should go, and the odds of obtaining what you believe would be a fair and equitable settlement, you need to seek the advice of counsel. Keep in mind that this advice is based purely on the little bit of
information that you have given to me. There certainly may be other factors
that would change my opinion. Further, no one can rely on advice from an
attorney who has not been retained. Since it appears that you have not
retained an attorney, before you take any further action, you should contact
