Legal Question in Family Law in New Jersey

Unwed parents - legal custody question

I live with BF currently. Throughout my pregancy endured a lot of ''emotional'' baggage,I wouldn't term it as abuse though some may. I am intimidated by him both physically and emotional b/c of what we have been through. My child was born Jan 2002. We currently still live together, splitting bills down the middle. More of a roommate relationship now although we bicker in regards to how things shoudl be done w/ child. (He constantly blames me for having/keeping baby.) My sanity is wearing thin and I need to remove myself physically from this relationship.

My question who has legal custody since we are unwed, if I move out now can I legally take the baby with me w/o filing some sort of papers w/ courts, how would physical/legal custody typically be decided?

Although you may move out with the child, remaining in the state of New Jersey, it is important that you obtain a Court Order addressing custody, visitation and child support.
