Legal Question in Family Law in New Jersey

Update Visitation Order

Ex moved with kids to another (far away) state. Visitation order changed from originally agreed local to long distance rules. I now moved within 120 miles of Ex and kids. Am I entitled to a change in visitation back to a local schedule with assistance from Ex to share responsibility of meeting half way to pickup kids for visitation? Ex says can't participate in transport due to commitments with her new family.

Re: Update Visitation Order

The information with your question indicates that the visitation orders, to date, are from a New Jersey court and that you now live in Maryland. I can't comment on New Jesey law, but under Maryland law your move to a short distance from your ex would be a basis for a second change in the visitation schedule, and generally the courts will require a sharing of transportation responsibility or, if that is not possible, a reduction in child support to compensate for the cost of transportation. You haven't said whether your ex also lives in Maryland or how long it is since your ex's move to this area. If the move was not recent, you may be able to have jurisdiction changed to this area where it is more convenient for both parents. It is certainly worth discussing this with a good family law lawyer in your area.
