Legal Question in Family Law in New Jersey

Upholding the divorce property agreement

I was recently divorced (two years). During our marriage, we had purchased a timeshare. It states in the divorce agreement that the wife will assume ownership and responsibility of payments and use of the property. The timeshare management has refused to acknowledge the clause in our divorce agreement and continues to keep me as a responsible party. She has not made payments for three months, and the timeshare management is threatening to demand full payment of the past due amount, and possibly reporting to the credit agencies. I've worked hard to rectify the damage to my credit due to the divorce, as well as paying for all of the accounts assigned to me in the agreement. I don't want this to ruin all of my hard work and I don't have the extra money to assume this debt.

What is the best option I can take to resolve this?

Re: Upholding the divorce property agreement

You might consider taking your ex back to Court to enforce your rights under the divorce agreement. If she's unwilling to pay for the timeshare, then you can ask the Court to order it sold at which time any arrearages would be paid off.
