Re: Vacation

Why would he want to? It's hard for me to answer this question without more facts. Certainly the type of vacation, travel plans, accomodations, etc. may all play into whether or not he would want to try to stop you and whether a Judge would grant that relief.

For instance, a white-water rafting trip with a kid who can't swim might be a problem. A trip out of the country where there is a fear that the parent would never return may be a cause for concern. I am assuming that you would not do either of these things; but you'd be surprised how many people would. The bottom line is that this is the type of issue that is very fact sensitive and a determination of those issues would reveal whether your exhusband can stop you from taking your kids on vacation.

Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, you may want to contact a Family Law attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. If you call me, mention Law Guru and your first one hour consultation will be free. Good luck! Rob Gleaner

Re: Vacation

Assuming it is just a normal one or two week vacation and its in the country, then no, I see no way he could.

This should all be part of your divorce. Sounds like you went without an attorney for the divorce. I suggest you see one now to take care of this problem and avoid all others in the future.
