Legal Question in Family Law in New Jersey

Can he visit his baby?

My friend's ex-fiance left him and took their baby with her a few weeks ago. They were living together for the first 3 months of the baby's life, but now the mother is telling him that he cannot see his child until they go to court in a few months. Can she legally do this? Does he have the right to see his child even though they are not married?

Re: Can he visit his baby?

Of course, but she "can" do this because there is no court order and the police will not get involved. He really should file a motion with the court ASAP and not wait to go to court in a few months. May be time to see an attorney to at least figure out what is going on here.

Yes, he has all sorts of rights, too complex to set out here. He has the right to see the child, certainly.

If he wants to hire an attorney, he should do so quickly and get started. He will have to go to Court, without doubt.
