Legal Question in Family Law in New Jersey

visitation

My ex-husband and I have joint legal custody of our 4 year old daughter. We have been seperated for almost 3 years and divorced since sept. Before the divorce he hadnt seen our daughter in 18 months I agreed to visitation one weekend month in NJ until he was settled with his own place in VA. Since September he has only seen her twice. Everytime he talks to her or sees her he says he wil see her soon and now its been 5 months since hes come to see her. The lack of visits and presence is hurting our daughter could i file to have all visitation stopped?

You sure could, but it will not be easy. Courts do not do this often. I suggest you consult with an attorney before you move forward.

You can file, but you need to show a substantial change in circumstances, and you might need an expert to say how the lack of visitation is affecting her. You might be able to limit his visitation and put additional restrictions on it, but it is very difficult to eliminate it.
