Wedding Deposits - Who is responsible when the engagement breaks up?
I was engaged July 4, 2000. On November 26, 2000, my fiance broke the engagement. I have put deposits down on the reception hall, photographer, dress, and entertainment totalling $3788. All of the contracts state ''non-refundable deposits'' and the reception hall has a clause that we will be responsible for half of the event if it does not rebook. My signature is the only one appearing on all the contracts although verbally my fiance agreed to the arrangements. Now, he claims that he will not pay since I signed for everything. Is he part or responsible for everything as he committed with a ring (price of $4600) to marry me?

It is interesting that you bring up the ring since the law in NJ would dictate that he be entitled to have the ring returned to him. The ring is a gift conditioned upon marriage. If the marriage does not occur, the ring would have to be returned. Your other issues are strictly a matter of contract law. In my opinion, a judge would view your wedding plans as a joint enterprise and require him to reimburse you for any losses. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since you have apparently not retained an attorney in this case, before you take any action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. It seems likely that he will not voluntarily reimburse you, so you will be required to file suit against him. In most cases, a lawyer would be able to do this better than an individual, although fees in this case may likely exceed the amount you are attempting to recover.
