Legal Question in Family Law in New Jersey

Last week my ex took my daughter for his visit. I realized my phone was missing. Instead of accusing him of taking it just to keep the peace I asked if it was in her bag? My surprise he said yes. Anyway I believe he found something against me in my text to try and take my daughter away and is taking me to court. Is he allowed to use what he found in my phone without my permission?
